GlowGirl Terms of Service

1. Eligibility

The Platform is intended for individuals 18 years of age or older and residents of the United States. By using the Platform, you represent and warrant that you:

• Are at least 18 years old (or at least 14 years old where expressly permitted with parental consent);
• Have the legal capacity to enter into these Terms;
• Are not prohibited from using the Platform under applicable law;
• Maintain only one GlowGirl account unless otherwise authorized;
• Provide true, current, and accurate information; and
• Will comply with these Terms and all applicable laws and regulations.

GlowGirl reserves the right to suspend or terminate accounts that violate these requirements.

2. Description of Services

GlowGirl provides a beauty membership and booking platform that offers both subscription-based memberships and Individual Services through participating Partner Salons.

GlowGirl Memberships may provide access to exclusive member pricing, promotional offers, and other membership benefits. Individual Services may be purchased by both Members and non-members at the pricing displayed at checkout.

GlowGirl facilitates bookings between users and Partner Salons but does not itself provide beauty services. GlowGirl is not responsible for the conduct, actions, omissions, licensing status, or quality of services provided by Partner Salons.

GlowGirl does not guarantee the availability of any particular salon, service, provider, or appointment time.

3. Account Registration and Security

You agree to:

• Provide accurate and complete registration information;
• Maintain the confidentiality of your account credentials;
• Promptly notify GlowGirl of any unauthorized use of your account;
• Accept responsibility for all activities occurring under your account.

GlowGirl is not responsible for losses resulting from your failure to maintain account security.

4. Memberships, Individual Services, and Payments

4.1 GlowGirl Memberships

GlowGirl may offer monthly or annual memberships that provide access to exclusive member pricing and other membership benefits.

Membership benefits may change from time to time at GlowGirl's sole discretion.

Memberships automatically renew unless canceled before the applicable renewal date.

By purchasing a Membership, you authorize GlowGirl to charge your selected payment method for all recurring membership fees until canceled.

4.2 Membership Fees and Refunds

Membership fees are charged at the beginning of each billing period and are non-refundable once charged except where required by applicable law.

No partial or prorated refunds will be provided for unused Membership periods unless otherwise required by law.

4.3 Membership Cancellation

You may cancel your Membership at any time through your account settings.

Cancellation will become effective at the end of your current billing period. You will continue receiving Membership benefits until the conclusion of the applicable billing period.

Canceling your Membership does not automatically cancel any previously purchased Individual Services or confirmed appointments.

4.4 Individual Services

GlowGirl may offer Individual Services that are purchased separately from Memberships.

Pricing for Individual Services may vary based upon:

• Membership status;
• Service type;
• Partner Salon;
• Promotional offers;
• Geographic location; and
• Other factors determined by GlowGirl.

GlowGirl reserves the right to modify pricing at any time prior to purchase.

4.5 Individual Service Refund Policy

You may receive a full refund for an Individual Service if all of the following conditions are satisfied:

• No appointment has been confirmed;
• The refund request is submitted within three (3) calendar days of purchase;
• The service is not designated as Final Sale or otherwise non-refundable; and
• GlowGirl has not substantially begun fulfilling or confirmed your booking request.

Refunds are not available if:

• An appointment has been confirmed;
• The appointment has been completed;
• The refund request is submitted more than three (3) calendar days after purchase;
• The service is designated as Final Sale or non-refundable;
• A payment dispute or chargeback has been initiated through your financial institution;
• GlowGirl reasonably determines that the refund request is fraudulent, abusive, or inconsistent with these Terms.

GlowGirl reserves the right, in its sole discretion, to issue GlowGirl account credit in lieu of a refund where appropriate.

4.6 Payment Authorization

By purchasing a Membership or Individual Service, you authorize GlowGirl to charge your selected payment method for:

• Membership fees;
• Individual Service purchases;
• Applicable taxes;
• Cancellation fees;
• No-show fees;
• Venue fees;
• Premium upgrades selected by you;
• Processing fees where disclosed at checkout; and
• Any other amounts expressly authorized by you.

Failure to successfully process payment may result in the suspension or cancellation of services or bookings.

4.7 Free Trials and Promotions

Providing payment information for any free trial or promotional offer authorizes GlowGirl to charge the applicable fee at the conclusion of the promotional period unless canceled before the stated deadline.

Promotional offers may be modified, suspended, or discontinued at any time unless otherwise required by law.

5. Partner Salon Terms

Partner Salons are independent businesses and are solely responsible for:

• Performing beauty services;
• Maintaining required licenses and permits;
• Maintaining insurance where required by law;
• Compliance with applicable health and safety regulations; and
• Their employees and independent contractors.

GlowGirl is not liable for Partner Salon operations, service quality, salon policies, injuries, allergic reactions, dissatisfaction with services, or employee conduct.

Partner Salons may offer premium upgrades or add-on services not included within GlowGirl pricing. Such amounts must be paid directly to the salon unless otherwise specified.

6. Booking Policies and Service Use

6.1 Appointments

All bookings, modifications, and cancellations must be made through GlowGirl unless otherwise authorized.

GlowGirl does not guarantee:

• Specific appointment times;
• Specific Partner Salons;
• Availability of any service; or
• Immediate appointment confirmation.

6.2 Membership Booking Policies

GlowGirl Memberships are designed for beauty maintenance purposes.

Members may schedule services according to their Membership benefits, recommended maintenance schedules, and the Fair Use Policy described below.

6.3 Late Cancellations and No-Shows

For Membership appointments:

• Late Cancellation (less than 12 hours before the appointment): $18 fee.
• No-Show or cancellation within 12 hours of the appointment time: $18 fee.

Repeated violations may result in temporary or permanent booking restrictions.

GlowGirl reserves the right to modify applicable fees upon reasonable notice.

6.4 Individual Service Cancellations

For Individual Services (à la carte, individually paid appointments):

• Appointments canceled twelve (12) or more hours before the appointment time receive a full refund.
• Appointments canceled less than twelve (12) hours before the appointment time receive a 50% refund; the remaining 50% is retained as the late cancellation charge, with no additional fee applied on top.
• Failure to attend a scheduled appointment constitutes a no-show and is non-refundable, except where GlowGirl determines in its sole discretion to issue a full or partial refund.

GlowGirl reserves the right to determine refund eligibility in individual circumstances, including for cancellations or no-shows it initiates on your behalf.

6.5 Partner Salon Availability

If a Partner Salon cannot accommodate a confirmed appointment, GlowGirl may, in its sole discretion:

• Reschedule the appointment;
• Offer an alternative Partner Salon;
• Issue GlowGirl account credit;
• Provide a refund for the affected Individual Service.

GlowGirl is not liable for incidental or consequential expenses resulting from canceled or rescheduled appointments, including transportation costs or lost wages.

6.6 No Membership Sharing

Memberships are intended solely for individual use.

Sharing, transferring, selling, or permitting another individual to use your Membership or account is strictly prohibited and may result in immediate termination without refund.

6.7 Visual Verification

Partner Salons may require reasonable verification that the individual receiving services matches the account holder.

You may be required to provide government-issued identification or complete GlowGirl's check-in procedures. Failure to comply may result in denial of service without refund.

6.8 Venue Fees and Premium Upgrades

Certain services may require additional charges for:

• Premium products;
• Specialty techniques;
• Longer appointments;
• Upgrades selected by you.

Such charges are not included unless expressly stated and are your responsibility.

6.9 Fair Use Policy

GlowGirl Memberships are designed for ongoing beauty maintenance rather than excessive usage.

GlowGirl reserves the right to:

• Limit booking frequency;
• Restrict appointment availability;
• Review Membership eligibility;
• Temporarily suspend booking privileges; or
• Terminate Memberships engaged in abusive or excessive usage patterns.

Determinations regarding excessive usage are made in GlowGirl's sole discretion and may consider service frequency, historical booking patterns, and generally accepted beauty maintenance practices.

6.10 Recommended Maintenance Schedules

Recommended maintenance schedules include:

• Nails (manicure/pedicure): every 7-15 days;
• Lash fills/refills: every 2-3 weeks;
• Eyebrow services: every 2-4 weeks;
• Facial and body waxing: every 3-6 weeks;
• Women's haircuts: every 4-8 weeks;
• Blowouts and styling services: every 1-2 weeks.

These schedules are guidelines only and may be considered when evaluating compliance with the Fair Use Policy.

7. Prohibited Conduct

You may not:

• Provide false or misleading information;
• Harass or abuse users, salons, or GlowGirl staff;
• Circumvent GlowGirl's booking or payment systems;
• Reverse engineer or interfere with the Platform;
• Use automated tools to scrape or harvest data;
• Engage in fraudulent activity;
• Abuse refund policies or promotional offers.

GlowGirl may immediately suspend or terminate accounts violating these Terms.

8. Intellectual Property

All Platform content, including logos, trademarks, software, graphics, text, and designs are owned by GlowGirl Inc. or its licensors.

No ownership rights are granted except as expressly stated herein.

9. Privacy

GlowGirl collects and processes information in accordance with its Privacy Policy.

By using the Platform, you consent to GlowGirl's collection and use of information necessary to provide services, process payments, facilitate bookings, and communicate with you.

You agree to indemnify and hold harmless GlowGirl, its affiliates, officers, employees, contractors, and Partner Salons from any claims, losses, liabilities, damages, expenses, and attorneys' fees arising from:

• Your use of the Platform;
• Your violation of these Terms;
• Your interactions with Partner Salons or other users;
• Fraudulent or unlawful conduct; or
• Your violation of applicable laws or regulations.

13. Modifications

GlowGirl may modify these Terms or any aspect of the Platform at any time.

Material changes will be communicated through the Platform or by email where appropriate.

Continued use of the Platform constitutes acceptance of any revised Terms.

14. Suspension and Termination

GlowGirl may suspend or terminate your account immediately if:

• You violate these Terms;
• You engage in fraudulent or abusive conduct;
• Payment cannot be successfully processed;
• You repeatedly violate booking policies or Fair Use requirements.

No refunds will be issued for terminated accounts except where required by applicable law.

15. Governing Law

These Terms are governed by the laws of the State of Delaware without regard to conflict-of-law principles.

16. Dispute Resolution and Arbitration

Any dispute arising from these Terms shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.

• Venue: New York County, New York (hearings may occur remotely where permitted);
• Class actions are prohibited;
• You waive any right to a jury trial.

You may opt out of arbitration by providing written notice within thirty (30) days of first accepting these Terms in accordance with GlowGirl's published procedures.

17. State-Specific Rights

Residents of certain jurisdictions may possess additional cancellation or refund rights that cannot be waived under applicable law.

If required by applicable law, such rights shall control to the extent of any conflict with these Terms.

If a Member dies or becomes permanently disabled during a prepaid Membership term, prorated refunds may be provided where required by law.

18. Miscellaneous

These Terms, together with GlowGirl's Privacy Policy and any applicable Purchase Terms, constitute the entire agreement between you and GlowGirl.

If any provision of these Terms is deemed unenforceable, the remaining provisions shall remain in full force and effect.

GlowGirl's failure to enforce any provision shall not constitute a waiver of its rights.
